Terms of Use

1. Acceptance of these terms

These Terms of Use ("Terms") govern your use of Noetis Phish Report and the website at https://phish.noetis.us (the "Service"), operated by Noetis ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. What the Service is — and is not

The Service analyzes a suspicious email file you upload and produces a plain-English report: what the message claims to be, why it looks the way it does, the supporting evidence, and suggested next steps.

• It is an explainer and triage tool for non-technical readers and the IT providers who serve them. It is not a replacement for comprehensive email-security, anti-malware, or email-gateway products, and it does not block, quarantine, or remove mail.
• Its verdicts are assessments, not guarantees. A "likely safe" result is not a promise of safety, and a "likely phishing" result is an opinion based on the available evidence. Evidence is often incomplete, and the report will say so. You remain responsible for your own security decisions; when in doubt, verify through an independent, trusted channel.
• It does not provide legal advice, and an Abuse Pack or report does not promise that any registrar, host, provider, or authority will act.

3. Accounts and eligibility

• You must be at least 18 years old and able to form a binding contract.
• You must register and verify your email address before analyzing a message. Authentication is handled by our identity provider; keep your credentials secure and enable multi-factor authentication where available.
• Provide accurate information and keep it current. You are responsible for activity under your account.
• You may use the Service individually or as part of an organization that shares a pooled credit balance. Organization membership is arranged with an administrator; you agree to join an organization only with authorization, and the reports you submit remain visible only to you (see our Privacy Policy).

4. Acceptable use

You agree that you will not:

• upload an email or content you do not have the right to submit, or that contains another person's data you are not authorized to share;
• use the Service to attack, overload, probe, or reverse-engineer it, or to circumvent rate limits, quotas, or access controls;
• create multiple accounts to obtain additional free trial credits, or use disposable/temporary email addresses to evade limits;
• upload malware for distribution, or use any output to facilitate wrongdoing;
• access or attempt to access another organization's — or another member's — data, jobs, reports, or account.

We apply rate limits and concurrency limits, and we may suspend or disable accounts that abuse the Service or threaten its cost or stability.

5. Credits and payments

• One credit equals one completed analysis. A completed analysis consumes one credit; an invalid file, a failed analysis, or a job you cancel before processing does not.
• Verified accounts may receive one free trial credit, which expires after a limited period.
• Paid credit packs and payments are processed by our third-party payment processor; we do not store your full card details. Purchased credits are subject to the expiry stated at purchase. Except where required by law, completed analyses are non-refundable.
• Subscriptions. If you subscribe to a monthly plan, it grants a recurring credit allowance and renews automatically each billing period until you cancel. You can cancel at any time to stop future renewals; unless required by law, payments already made are not refundable, and credits already granted remain subject to their stated expiry and any rollover limit. Plan details, prices, and included amounts are shown at checkout and may change on renewal with notice.

6. Your content and our use of it

You retain ownership of the files you upload. You grant us a limited license to process them solely to provide the Service. We delete the raw uploaded file after analysis and retain only extracted evidence and the report, as described in the Privacy Policy and Security statement. We do not sell your data.

7. Service availability and changes

The Service is provided on an "as available" basis. We may modify, suspend, or discontinue features, and we may impose or change limits, at any time. We will try to give reasonable notice of material changes where practical.

8. Disclaimer of warranties

THE SERVICE AND ALL REPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free, or that any verdict is correct or complete.

9. Limitation of liability

To the maximum extent permitted by law, Noetis will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on a report or verdict. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the three months before the claim, or USD 100.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination (e.g., disclaimers, limitation of liability) will survive.

11. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws rules. The courts located there will have exclusive jurisdiction, except where applicable law provides otherwise.

12. Changes to these Terms

We may update these Terms from time to time. The "Effective" date above shows the current version. Material changes will be reflected here, and continued use after an update constitutes acceptance.
